ZADV ADULT RALLY EVENTS WAIVER

Read this complete agreement before signing. This agreement affects legal rights, including the right to bring certain claims where permitted by law. The event is identified above, and the rider is identified in the fields below.
1 Activity covered
In consideration of being allowed to participate, I voluntarily enter this agreement for the motorcycle rally event identified above, including navigation, roadbook or GPS use, route riding, checkpoints, practice activities, and other activities described in the event registration materials. This agreement applies only to this event and its associated activities, including travel to, from, and during the event to the extent permitted by law. Any timed or competitive component must be expressly identified in those materials. Event states covered by this agreement: South Carolina, North Carolina, Virginia, Kentucky, West Virginia, and Pennsylvania.
2 Risks and voluntary participation
Motorcycle activities can cause serious physical or psychological injury, illness, permanent disability, paralysis, death, and property or financial loss. Risks may arise from my actions, the actions of others, equipment, terrain, facilities, traffic, weather, dehydration, or the condition of participants. Rally risks include navigation distraction, roadbook or GPS errors, missed turns, getting lost, unfamiliar terrain, loose surfaces, obstacles, collisions, other riders and traffic, fatigue, mechanical failures, weather, and delayed assistance in remote areas. Time pressure, scoring, or competition, if included in the event, may increase risk. Routes may use public roads and may be open to other users; I will not assume a route is closed or controlled. I understand these risks, including risks not known or foreseeable to me, and voluntarily assume them to the extent permitted by law. This risk acknowledgment does not transfer the organizer's legal safety duties to me.
3 Release of liability
To the extent permitted by applicable law, I release and discharge ZADV, Inc., its directors, officers, employees, instructors, guides, agents, volunteers, and affiliates involved in this event (the Released Parties) from claims arising out of my participation, including claims for personal injury, death, and property damage caused by their ordinary negligence. This release does not apply to gross negligence, reckless or intentional misconduct, or any claim or liability that applicable law does not permit to be released. I do not waive rights that cannot lawfully be waived. For an event in Virginia, this agreement does not release negligence claims for personal injury or death.
4 Participant responsibilities
I will obey traffic laws, land-use restrictions, event rules, and official instructions, and will not allow navigation, scoring, or timing to override safe riding. I will stop in a safe place when needed to read or adjust navigation equipment. I will ride within my abilities, observe restricted areas, and follow the event check-in, withdrawal, and emergency procedures. I may refuse a route segment or stop participating if I believe conditions are unsafe. I will not participate while impaired by alcohol, drugs, medication, or any condition that prevents safe participation. I will disclose limitations relevant to safe participation and comply with event equipment and eligibility requirements.
5 Medical care and vehicle costs
If emergency assistance is needed, I authorize event personnel to contact emergency services. I understand that medical care or evacuation may be delayed and that assistance is not guaranteed. I am responsible for medical, rescue, evacuation, and vehicle repair costs for which I am legally liable. I should carry appropriate health coverage and must carry any vehicle insurance required by law and the event. This agreement does not provide insurance coverage.
6 Indemnification and property damage
To the extent permitted by law, I agree to indemnify and hold harmless the Released Parties against third-party claims, damages, and reasonable legal costs to the extent caused by my negligent, reckless, or intentional acts during this event. This obligation does not extend to the Released Parties' own negligence or misconduct. I am responsible for equipment or facility damage for which my actions make me legally liable.
7 Applicable limits
This agreement applies only as permitted by applicable law. If a provision is held invalid, the remaining provisions continue to apply to the extent legally permitted. Any obligations concerning my estate, heirs, or personal representatives apply only to the extent permitted by law. This agreement does not replace any separate release required by a venue or insurer.
8 Acknowledgment and signature
I have read this complete agreement, understand the activities and risks described, and understand that I am giving up certain legal rights where permitted by law. I have had an opportunity to ask questions and sign freely and voluntarily. I confirm that I am at least 18 and have reached the age of majority in the applicable jurisdiction. Rally participation is restricted to adults.
Each rider must submit their own signed agreement. A buyer cannot sign for other riders. I intend my electronic signature below to sign this agreement.
